Clause 1: Date of effect of Agreement
I beg to move that the House do agree with the Commons in their Amendment Nos. 1 and 2, and in Amendment No. 3 inserted lower down on the same page.
The noble Earl said: I rise to move Amendments Nos. 1 and 2, and also to speak to Amendment No. 3, which deals with the same subject-matter as Amendments Nos. 1 and 2. I will explain in a moment the reason why I am not moving all three together. They deal with Clause 1 of the Bill, which relates to the coming into effect of the scheduled double taxation agreement between the Government of the United Kingdom of Great Britain and Northern Ireland and the Government of Switzerland. I will try to explain the general purpose of the Bill and these amendments and then I will deal with the amendments in more detail. I would like to make helpful use of the opportunity to explain these matters to the House this evening.

SECOND SCHEDULE
I beg to move Amendment No. 6.
The noble Earl said: I rise to move Amendment No. 6, which deals with the Second Schedule of the Bill, which gives the text of the scheduled double taxation agreement between the two Governments. The purpose of the amendment is to correct in certain respects an oversight in the way in which the agreement is drafted, by inserting an obligation on the part of the Swiss Government to inform the United Kingdom authorities if a double taxation relief is granted to a company not liable to tax in Switzerland. That is the purpose of the amendment and I will go into it in more detail in a moment.
Amendment No. 7
The noble Earl said: I beg to move Amendment No. 7, which deals with sub-paragraph in paragraph 2 of the Schedule and which provides that, where a company is liable to pay tax in both countries, the authorities of the two countries shall consult together in order to resolve the question of which country should grant double taxation relief. I hope to be able to show the purpose and value of that provision to the House in a moment.
Amendment No. 8
The noble Earl said: I beg to move Amendment No. 8, which deals with a technical matter in sub-paragraph of paragraph 2 of the Schedule. It deals with a particular point which arises because the rules for computing in Switzerland the tax base for companies subject to Part 3 of the Federal Law on Direct Federal Tax are significantly different from those in the United Kingdom. That is a point which arises because of differences in the legislation and, obviously, if the Schedule is to have any meaning as between the two countries it has to be taken into account.
Amendment No. 9
The noble Earl said: I beg to move Amendment No. 9, which deals with the subject-matter of the new paragraph 3A. Paragraph 3A provides for the tax base to be determined according to the same principles in both countries in respect of foreign dividends, thereby preventing double taxation. In broad terms, the purpose of the amendment is to assist in the administration of that part of paragraph 3A which relates to comparability of accounts in two countries.

The noble Earl said: I rise to move Amendment No. 10 which, I hope, will commend itself to the House. It deals with a related but, nevertheless, outstanding matter. It relates to rates of taxation to which the agreement applies in Switzerland in relation to dividends taken at the rate of 5 per cent. and interest at the rate of 10 per cent. That is provided for in sub-paragraph of the new amendment. It also deals with the reduction of those rates, the notification of the Treasury and the prohibition of any such reduction taking effect under this Agreement. That is dealt with in sub-paragraph . I hope that noble Lords will agree that this is a sensible and straightforward amendment and one which commends itself to the House.
Amendments Nos. 11 and 12
The noble Earl said: I beg to move Amendments Nos. 11 and 12, which are consequential on Amendment No. 10 which we have just accepted, once again dealing with related but outstanding matters and, if I may say so, at this stage dealing with a technical point. Amendments Nos. 11 and 12 provide for the addition of a defined term to the definitions in section 977 of the Income and Corporation Taxes Act, which is in the area of corporation tax. This obviously provides for the taxation of dividends and interest at 5 per cent. and 10 per cent. in Switzerland, ensuring that these provisions can be implemented in United Kingdom law. In this regard, I hope that noble Lords will agree that the purpose of these amendments is to implement in full the terms of Amendment No. 10, which we have just accepted.
I beg to move Amendment No. 13.
The noble Earl said: I rise to move Amendment No. 13 which relates to a matter of interpretation. It is a drafting amendment which deals with the question of whether there is any ambiguity in the form of words used in subsection of the existing Clause 10. It provides that there is to be no ambiguity. This amendment prevents the possibility that some person or persons in Switzerland might take advantage of the Scheme through a misinterpretation of the section.
